Art2fund Terms and Conditions
These Terms and Conditions govern your access to and use of the websites, online stores, class websites, school administration tools, teacher tools, student personal pages, digital galleries, museum pages, museum shops, coordinator portals, ordering tools, fundraising tools, and related services operated by Art2fund Inc. ("Art2fund," "we," "us," or "our").
Art2fund provides art-based educational, creative, fundraising, and commerce programs for schools, organizations, students, families, and supporters. Our programs may include classroom art projects, inspirational art materials, digital class environments, student artwork pages, class galleries, school galleries, online museums, museum shops, customized product ordering, fundraising campaigns, payment processing, production, fulfillment, reporting, and related support services.
By accessing our website, participating in an Art2fund program, submitting artwork or other content, scanning or using a QR code, activating a personal page, viewing a gallery or museum page, using an access code, placing an order, or otherwise using our services, you agree to be bound by these Terms and Conditions.
If you are using the services on behalf of a school, parent-teacher organization, nonprofit organization, business, district, or other participating organization, you represent that you have authority to act on behalf of that organization and to bind it to these Terms.
If you do not agree to these Terms, you should not use our website, participate in a program, submit artwork, activate or access a personal page, access a class website, access a gallery or museum, or place an order.
For purposes of these Terms, the following definitions apply:
"Access Code" means a code, QR code, link, login credential, or other access method provided by Art2fund or a Participating Organization to access, activate, administer, or view part of the Services.
"Artwork" means the student's original drawing, painting, design, or other visual work submitted or processed for an Art2fund Program. Artwork does not include the student's name, class information, email address, account information, captions, messages, or other personal information, although those items may be associated with the Artwork as User Content or Student Information.
"Artwork Sheet" means the paper, template, or other physical or digital submission format used for a Program. An Artwork Sheet may include a designated drawing area and a separate designated name or class area.
"Buyer" means any person who places or attempts to place an order through the Services.
"Class Gallery" means a gallery within a Class Website that may show activated student Artwork for a specific class and is intended for teacher access.
"Class Website" means a digital class environment provided through the Services and accessed by a Teacher using login credentials or another authorized access method.
"Digital Project Pages" means the digital pages and environments made available through the Services for a Program, including Personal Pages, Museums, Museum Shops, Class Websites, Class Galleries, School Galleries, online stores, and related project pages.
"Museum" means a student-specific digital display page or environment where a student's activated Artwork may be shown to people who have received the relevant direct link or Access Code.
"Museum Shop" means a student-specific online shop where Buyers may purchase customized products featuring the Artwork associated with that student's activated Program participation.
"Parent" means a parent or legal guardian of a Student Artist.
"Participating Organization" means a school, district, parent-teacher organization, parent-teacher association, nonprofit organization, business, or other organization that participates in or helps organize a Program.
"Personal Page" means a student-specific page that may be activated through a QR code, Access Code, or direct link and that is intended for use by the applicable Student Artist and Parent.
"Program" means an art education, creative project, fundraising, commerce, gallery, museum, or related program offered or supported by Art2fund. A Program may be art-education-first, fundraising-first, or a hybrid of both.
"Program Proceeds" means fundraising proceeds, commissions, revenue shares, credits, or other program benefits that may be payable or credited to a Participating Organization under the applicable Program terms or a separate written agreement with Art2fund.
"Products" means customized products sold by Art2fund through the Services and made using the Artwork associated with a specific Student Artist's activated Museum Shop or ordering flow.
"School Coordinator" means the person designated by a Participating Organization to organize, administer, or coordinate a Program for that Participating Organization.
"School Gallery" means a gallery that may show activated student Artwork for a Participating Organization and that may be made available through a direct link. The School Coordinator or Participating Organization is responsible for deciding whether and how to share that link, subject to applicable school policies, these Terms, and any separate written agreement with Art2fund.
"Services" means the websites, online stores, class websites, school administration tools, teacher tools, Personal Pages, Digital Project Pages, galleries, Museum pages, Museum Shops, coordinator portals, ordering tools, fundraising tools, customer support, production coordination, fulfillment coordination, and related services operated or provided by Art2fund.
"Student Artist" means a student or child whose Artwork is submitted, uploaded, scanned, processed, activated, displayed, or used in connection with a Program.
"Student Information" means information relating to a Student Artist, such as name, class, school, email address, activation details, order-related information, or other information associated with the Student Artist or the Student Artist's Artwork.
"Teacher" means a teacher or other classroom representative authorized by a Participating Organization to access a Class Website or Class Gallery.
"User" means any person or entity that accesses or uses the Services, including Participating Organizations, School Coordinators, Teachers, Parents, Student Artists, Buyers, invited viewers, and website visitors.
"User Content" means any content or information submitted, uploaded, entered, provided, displayed, shared, or otherwise made available through the Services by or on behalf of a User, including Artwork, Student Information, names, class information, email addresses, captions, messages, selections, uploads, order details, and other submitted information.
Art2fund offers creative school programs that combine student artwork, digital presentation, optional product ordering, and, where selected by the school or organization, fundraising.
Art2fund may offer multiple types of Programs, including:
Not every Art2fund Program includes fundraising. Some Programs focus primarily on art education, student participation, digital presentation, galleries, Museums, and optional product purchases. Other Programs focus primarily on fundraising through customized Products made from student Artwork.
Depending on the Program selected by the Participating Organization, Art2fund may provide Services including:
Art2fund Programs may include a digital project environment with different levels of access for Student Artists, Parents, Teachers, School Coordinators, Participating Organizations, Buyers, and invited viewers.
Before activation, a Participating Organization may provide Art2fund with scanned Artwork Sheets. Art2fund may process those scans by separating the designated drawing area from the designated name or class area. At that stage, Art2fund may have only the Artwork image and a separate image of the name or class area, without an activated Personal Page or additional Student Information.
A Student Artist may receive a flyer containing a QR code or Access Code. The QR code or Access Code can be used to activate the Student Artist's Personal Page.
The Personal Page is intended for the Student Artist and the Student Artist's Parent. During activation, the Parent, or the Student Artist with the Parent's authorization, may be asked to enter or confirm certain details needed to operate the page, connect the Artwork to the correct Student Artist or class, and support ordering or Program participation. These details may include the Student Artist's name, class, and an email address.
Only the Student Artist's Parent, or the Student Artist with the Parent's authorization, should activate or manage the Student Artist's Personal Page. Activation may require acceptance of student participation terms, privacy notices, or other Program-specific terms.
After a Personal Page is activated, the Student Artist and/or Parent may invite family members, friends, and supporters to view the Student Artist's Museum and Museum Shop.
The Student Artist's Museum and Museum Shop are accessible to people who receive the relevant direct link or QR code. These pages are not intended to be searchable public profile pages, but anyone who receives the link may be able to access them.
Parents are responsible for deciding who they invite to the Student Artist's Museum or Museum Shop.
Art2fund will not publish or share a real Student Artist's active Museum or Museum Shop for Art2fund's own public marketing, advertising, social media, portfolio, or unrelated promotional purposes unless Art2fund obtains any separate permission required by law.
Class Websites are intended for access by the applicable Teacher using a username and password or other login credentials.
The Class Gallery is part of the Class Website and is intended for Teacher access. It may show activated student Artwork for the applicable class.
Only Artwork from Student Artists whose Personal Page has been activated through the QR-code or Access-Code process, with Parent authorization, should be visible in the Class Gallery.
School administration tools are intended for access by the School Coordinator or other authorized school administrator using a username and password or other login credentials.
The School Gallery may be made available through a direct link. The School Coordinator or Participating Organization is responsible for deciding whether and how to share that link, subject to school policies, these Terms, and any applicable agreement with Art2fund. For example, the School Coordinator or Participating Organization may choose to share the link only with parents, share it with the school community, post it on a school website, share it with local media, or not share it.
Only Artwork from Student Artists whose Personal Page has been activated through the QR-code or Access-Code process, with Parent authorization, should be visible in the School Gallery.
If a Student Artist's QR code is not scanned and the Student Artist's Personal Page is not activated, the Student Artist's project participation ends at the non-activated Artwork stage.
For non-activated Artwork, Art2fund should not receive or process personal details beyond the Artwork image and the separate image of the information written on the designated name or class area of the Artwork Sheet, such as first name and class. Non-activated Artwork should not be published further in a Personal Page, Museum, Museum Shop, Class Gallery, or School Gallery.
For purchases made through Art2fund websites, online stores, Museum Shops, Personal Pages, Class Websites, School Galleries, or other Art2fund-operated ordering tools in the United States, Art2fund Inc. acts as the seller of the Products unless expressly stated otherwise.
Art2fund is responsible for processing customer orders, collecting payment, collecting applicable sales tax, arranging production, and coordinating fulfillment of Products purchased through its Services.
Participating Organizations may receive Program Proceeds depending on the applicable Program terms or separate written agreement with Art2fund. However, unless expressly stated otherwise, Participating Organizations are not the seller of Products purchased through Art2fund-operated stores.
Products sold through a Student Artist's Museum Shop or ordering flow are custom-made using the Artwork associated with that specific Student Artist's activated Program participation.
Participating Organizations are responsible for deciding whether to participate in an Art2fund Program, selecting the applicable Program, appointing a School Coordinator, authorizing Teachers or administrators, communicating Program information to families and participants, and obtaining any internal approvals required by their own policies.
Art2fund provides the platform, tools, educational project environment, Artwork presentation features, commerce functionality, production services, fulfillment services, and related support needed to operate the selected Program.
Participating Organizations may also enter into a separate written agreement with Art2fund. These Terms apply in addition to any such agreement. If there is a conflict between these Terms and a separate written agreement signed by Art2fund, the separate written agreement will control only for the subject matter covered by that agreement.
Participating Organizations are responsible for deciding how to communicate School Gallery links, Program information, fundraising information, and other project details to their communities, subject to applicable law, school policy, and any written agreement with Art2fund.
These Terms apply to all users of the services, including:
Additional terms may apply to specific programs, products, promotions, privacy practices, student data arrangements, district agreements, or data processing agreements.
The Services are intended for use by adults, Participating Organizations, School Coordinators, Teachers, Parents, Buyers, and Student Artists participating with appropriate Parent or Participating Organization involvement.
You may place an order through the Services only if you are at least 18 years old or are using the Services with the involvement and permission of a Parent or legal guardian.
Student Artists may participate in a Program only through a Participating Organization and with the required involvement, authorization, or consent of a Parent or legal guardian where applicable. A Student Artist should not activate or manage a Personal Page unless the Student Artist's Parent or legal guardian has authorized that activation.
During activation of a Personal Page, Art2fund may require the activating person to confirm that they are the Parent or legal guardian of the applicable Student Artist and that they agree to the applicable student participation terms, privacy notices, and any Program-specific terms.
Art2fund may rely on the information and confirmations provided during activation, checkout, or use of the Services. Art2fund may suspend or remove access if it reasonably believes that a Personal Page, Museum, Museum Shop, gallery, order, or other use of the Services has been activated or used without the required authorization.
Access Codes, QR codes, direct links, usernames, and passwords are used to access different parts of the Services. Users are responsible for using those access methods only for their intended purpose.
Parents are responsible for deciding who they invite to a Student Artist's Museum or Museum Shop. A Museum or Museum Shop link may be accessed by anyone who receives it, and Art2fund cannot guarantee that a link remains private after a Parent, Student Artist, Buyer, or invited viewer shares it.
The School Coordinator or Participating Organization is responsible for deciding whether and how to share a School Gallery link. Art2fund cannot guarantee that a School Gallery link remains private after the School Coordinator, Participating Organization, or another recipient shares it.
Class Websites and Class Galleries are accessed by Teachers using a username and password. Teachers are responsible for keeping their login credentials confidential and for using the Class Website and Class Gallery only for authorized Program purposes.
School administration tools are accessed by the School Coordinator or other authorized school administrator using a username and password. The School Coordinator may be able to view, manage, or resend login credentials for Teachers or other authorized users through the school administration portal.
The Participating Organization is responsible for ensuring that only authorized people receive or use Teacher, School Coordinator, or administrator access.
Buyers do not need to create an Art2fund account to place an order. Buyers place orders through guest checkout.
During guest checkout, the Buyer is responsible for providing accurate order, contact, shipping, and payment information and for reviewing the selected Artwork, Products, quantities, personalization, and delivery details before submitting the order.
Before any Products have been ordered through the applicable Personal Page, Museum Shop, or ordering flow, a Parent may be able to change the Student Artist's name, class, or email address through the available project tools. Before any Products have been ordered, the School Coordinator may also be able to correct the Student Artist's name or class through the school administration tools.
After a Product has been ordered, changes to the Student Artist's name, class, email address, Artwork association, or related order-relevant information may be made only by Art2fund customer support, where feasible. This limitation helps prevent production, personalization, fulfillment, and customer-service errors after an order has been placed.
Each Personal Page may include a removal or deletion option. A Parent may also contact Art2fund customer support to request removal or deactivation of a Personal Page, Museum, Museum Shop, or related Digital Project Pages.
Art2fund may need to retain certain records after removal or deactivation where required for order fulfillment, customer support, accounting, legal compliance, security, fraud prevention, dispute handling, or other legitimate business purposes described in the applicable privacy notice.
Users may not:
Art2fund may block, suspend, restrict, remove, or disable any Access Code, link, Personal Page, Museum, Museum Shop, gallery, account, order, content, or access to the Services if Art2fund reasonably believes there has been misuse, unauthorized access, a privacy complaint, a security issue, a legal risk, a violation of these Terms, or another issue that may harm Art2fund, a Participating Organization, a Student Artist, a Parent, a Buyer, or another person.
Art2fund does not claim ownership of the original Artwork submitted in connection with a Program. Ownership of the original Artwork remains with the Student Artist, Parent, or other person or entity that owns it.
Users are responsible for ensuring that they have the rights and permissions needed to submit, upload, activate, display, share, or use Artwork and other User Content through the Services.
By submitting, uploading, providing, activating, displaying, sharing, or otherwise making Artwork or User Content available through the Services, the applicable User grants Art2fund a limited, non-exclusive, royalty-free, worldwide license to copy, scan, upload, crop, resize, edit, color-adjust, enhance, format, display, host, store, reproduce, print, manufacture, process, and otherwise use the Artwork and User Content for purposes related to the applicable Program and Services.
This license includes the right to use Artwork and User Content to:
Art2fund may use Artwork and User Content internally for service training, support training, quality control, production review, troubleshooting, and operational improvement, provided that real Student Artist Artwork from an active Program is not published externally for unrelated marketing or promotional purposes without any separate permission required by law.
Art2fund may use demo Artwork, sample Artwork, mockups, anonymized examples, or non-student example materials for marketing, training, product previews, sales materials, website examples, or other business purposes.
Art2fund will not publish or share a real Student Artist's active Artwork, Personal Page, Museum, Museum Shop, or related Digital Project Pages for Art2fund's own public marketing, advertising, social media, portfolio, or unrelated promotional purposes unless Art2fund obtains any separate permission required by law.
Art2fund may crop, resize, rotate, adjust, color-correct, enhance, clean up, remove backgrounds from, or otherwise process Artwork when Art2fund determines that such processing is useful for operating the Program, presenting the Artwork, creating product previews, or producing Products.
However, Art2fund does not promise to review, correct, improve, repair, clean up, rotate, crop, color-correct, or otherwise fix every Artwork file, scan, upload, preview, or product layout. Art2fund may notice and correct certain issues, and may provide support on request where feasible, but Users should not assume that Artwork issues will be identified or corrected automatically.
Users may not submit, upload, activate, display, share, or use Artwork or User Content that:
Art2fund may refuse to process, publish, display, produce, fulfill, or support any Artwork, User Content, Personal Page, Museum, Museum Shop, gallery, order, or Product if Art2fund reasonably believes that the Artwork or User Content violates these Terms, may infringe another person's rights, may be inappropriate for the Services, may create legal or operational risk, or may harm Art2fund, a Participating Organization, a Student Artist, a Parent, a Buyer, or another person.
Art2fund may remove Artwork or User Content from a Program, deactivate related Digital Project Pages, cancel or refuse orders, or decline production where appropriate. Art2fund may do so before or after activation if the issue is discovered or reported.
After activation, Artwork may be replaced only in specific cases approved by Art2fund, such as a technical issue, incorrect Artwork association, processing issue, upload error, or other problem that Art2fund determines should be corrected. Artwork replacement is not intended as a general option to switch to a different drawing after activation simply because a User prefers another drawing.
After Products have been ordered, Artwork replacement may be limited or unavailable because the existing Artwork may already be tied to product previews, orders, production, fulfillment, customer-service records, or Program reporting.
The Participating Organization and School Coordinator are responsible for collecting, scanning, uploading, reviewing, and submitting Artwork Sheets according to the applicable Program instructions, unless Art2fund has expressly agreed to perform specific steps.
The Participating Organization and School Coordinator are responsible for checking, before official submission, that uploaded Artwork is associated with the correct class or student records available to them and that scans, uploads, cropping, orientation, visibility, and file quality are suitable for the Program.
Art2fund is not responsible for errors caused by school-side scanning, uploading, cropping, orientation, file quality, class assignment, name or class information, or other submission issues unless Art2fund expressly caused the error.
Parents are responsible for entering or confirming the Student Artist's name, class, email address, and other activation details accurately.
Buyers are responsible for reviewing the Artwork, Product previews, personalization, names, class information, product selections, quantities, shipping information, and all other order details before submitting an order.
Products are produced based on the Artwork, previews, personalization, and order details shown or selected in the ordering flow. If a Buyer orders a Product using Artwork that is stained, smudged, incorrectly oriented, poorly scanned, poorly cropped, associated with the wrong Student Artist, or otherwise visibly incorrect in the ordering flow, the Product may be produced with that same issue.
If a Parent or Buyer believes that Artwork, Student Information, a preview, or an order detail is incorrect, they should contact Art2fund customer support before placing an order or before the applicable production deadline. Art2fund is responsible for correcting or remedying errors that Art2fund or its production partners cause during production, subject to the applicable refund, replacement, and support policies. Art2fund is not responsible for issues that were visible or knowable before checkout and were caused by school-side submission, User-provided information, Artwork quality, scan quality, upload quality, cropping, orientation, or Buyer selection.
Product previews are intended to help Buyers review the selected Artwork and Product before ordering, but previews may not perfectly represent the final Product.
Colors, brightness, contrast, cropping, scale, placement, texture, material, print position, and overall appearance may differ between the on-screen preview and the final printed or manufactured Product. Differences may result from screen settings, production processes, material properties, product shape, print tolerances, Artwork quality, scan quality, cropping, or other technical factors.
Art2fund may refuse refund or replacement requests where the Product is a reasonable reproduction of the Artwork, preview, or order information submitted or selected by the Buyer, even if the Buyer later decides that they would have preferred a different crop, orientation, color, Artwork file, or Product selection.
Products sold through the Services are custom-made using the Artwork associated with a specific Student Artist's activated Museum Shop, Personal Page, or ordering flow.
An order is final when the Buyer completes checkout and payment is accepted or authorized, subject to Art2fund's rights to cancel, refuse, refund, or decline an order as described in these Terms.
Before submitting an order, the Buyer is responsible for reviewing:
Some Products may include the Student Artist's name or other personalization depending on the Product variation selected by the Buyer. The name used for personalization may be based on the name entered or confirmed during Personal Page activation. The Buyer is responsible for reviewing that personalization before ordering.
What is shown or selected in the shop preview and checkout flow is generally what will be produced, subject to reasonable production, material, color, placement, scale, texture, and technical variations.
Art2fund may refuse, cancel, decline, or refund an order, in whole or in part, if:
If Artwork or User Content is refused after checkout but before production, Art2fund may cancel or refund the affected order. Art2fund is not required to request or accept replacement Artwork before canceling or refunding the order.
Product prices shown in the online store are exclusive of applicable sales tax unless expressly stated otherwise.
Applicable sales tax is calculated and added in the shopping cart or checkout flow and is visible to the Buyer before the order is submitted. Art2fund collects and remits applicable sales tax as required by law.
Prices, Products, shipping charges, handling charges, sales tax calculations, discounts, and promotions may change from time to time. Art2fund may correct errors in prices, Product information, promotions, taxes, or checkout totals, including after an order is submitted, where permitted by law.
Art2fund may use third-party payment processors to process payments. By submitting payment information, the Buyer authorizes Art2fund and its payment processors to charge the applicable payment method for the order total, including Products, shipping, handling, applicable sales tax, and any other charges shown at checkout.
Art2fund is not responsible for delays, refusals, holds, chargebacks, payment failures, or payment-processing errors caused by the Buyer, the Buyer's card issuer, bank, payment provider, or other third-party payment service.
Art2fund may offer discounts, coupon codes, credits, or promotions. Unless expressly stated otherwise:
Art2fund currently provides direct home delivery for US orders unless a different delivery method is expressly offered in the checkout flow or separate Program terms.
Production times, shipping times, delivery dates, and arrival estimates are estimates only and are not guaranteed unless Art2fund expressly states otherwise in writing.
Products in the same order may be produced at different times, by different production methods, or from different fulfillment locations. Art2fund may ship Products in partial shipments depending on Product type, availability, production timing, packaging requirements, or fulfillment logistics.
The Buyer is responsible for providing a complete and accurate shipping address. Art2fund is not responsible for delivery failure, delay, loss, non-delivery, return, extra shipping cost, or misdelivery caused by an incorrect, incomplete, outdated, inaccessible, or undeliverable address provided by the Buyer.
If a package is lost, delayed, damaged, or marked delivered by a carrier but not received by the Buyer, Art2fund may review the issue with the carrier and determine the appropriate resolution on a case-by-case basis. Art2fund may require the Buyer to provide information, documentation, photographs, carrier communications, or other cooperation needed for a carrier investigation.
Product availability may change at any time. Products may be discontinued, removed from the assortment, become temporarily unavailable, become permanently unavailable, or be unavailable for a specific Program, region, or production period.
If a Product is unavailable after an order is placed, Art2fund may cancel and refund the affected Product or order. Art2fund is not required to provide a substitute Product. Art2fund may offer a comparable alternative at its discretion, but no substitution will be required unless accepted or otherwise permitted under the applicable order flow or support resolution.
Because Products are custom-made, orders cannot be freely canceled after checkout.
Art2fund may be able to cancel an order if the Buyer contacts customer support before the order enters production, but cancellation is not guaranteed and no fixed cancellation window applies. Once production has started, cancellation may be unavailable.
Because Products are custom-made using student Artwork and, in some cases, personalization, Art2fund does not accept returns or exchanges because a Buyer changes their mind, selects the wrong Product, enters or confirms incorrect information, overlooks an issue visible in the preview, or later prefers a different Artwork file, crop, orientation, color, Product, or personalization.
This return policy does not limit any rights that cannot be waived under applicable law.
If a Product arrives damaged, defective, or materially different from what was ordered because of an Art2fund or production partner error, the Buyer should contact Art2fund customer support as soon as possible and no later than seven days after delivery, unless a longer period is required by applicable law.
The Buyer may be required to provide photographs of the Product, packaging, shipping label, damage, defect, incorrect item, or other issue before Art2fund provides a replacement, refund, credit, or other resolution.
Art2fund may choose the appropriate resolution on a case-by-case basis, including replacement, refund, partial refund, credit, or another reasonable remedy. Art2fund may provide a replacement first where replacement is reasonably available, but Art2fund may provide a refund or other resolution where replacement is not feasible or appropriate.
Art2fund is responsible for errors caused by Art2fund or its production partners during production, personalization, or fulfillment, subject to these Terms and the applicable support policy. Art2fund is not responsible for issues caused by school-side scanning, uploading, cropping, orientation, file quality, name or class information, User-provided information, Buyer selections, shipping address errors, or issues that were visible or reasonably knowable before checkout.
For carrier damage, delay, loss, non-delivery, or disputed delivery, Art2fund may review the issue with the carrier and determine the appropriate resolution after reasonable investigation. Art2fund may decline a refund or replacement if tracking, carrier information, delivery confirmation, Buyer-provided information, or other circumstances do not support the claim.
Refunds, where provided, will generally be issued to the original payment method unless Art2fund determines another method is appropriate or required by law. Processing times may depend on the payment processor, card issuer, bank, or other payment service provider.
A Participating Organization may be signed up for a Program by a school employee, district representative, PTO/PTA representative, parent organization representative, classroom representative, or other person acting for or with the Participating Organization.
By signing up, registering, starting, submitting, administering, or coordinating a Program, the person acting for the Participating Organization represents that:
The Participating Organization is responsible for deciding whether to participate in a Program and for obtaining any internal, district, PTO/PTA, board, administrative, fundraising, vendor, procurement, data, privacy, or policy approvals required before participation.
Art2fund is not responsible for a Participating Organization's internal approval process, school policies, district policies, PTO/PTA approvals, fundraising approvals, vendor registration requirements, procurement requirements, student-data policies, or other local requirements unless expressly agreed in a separate written agreement signed by Art2fund.
A Participating Organization may upload scanned Artwork Sheets before a Student Artist's Personal Page is activated. At that stage, Art2fund may process the uploaded Artwork Sheet to create a drawing image, a separate name or class image, and a downloadable flyer with a personal QR code or Access Code linked to the applicable Artwork.
Parent authorization, student participation terms, and privacy notices are handled through the Personal Page activation process, unless a separate written agreement or Program-specific requirement states otherwise.
Only after the Personal Page is activated with Parent authorization should the Student Artist's Artwork become visible in the applicable Personal Page, Museum, Museum Shop, Class Gallery, or School Gallery.
The Participating Organization and School Coordinator are responsible for collecting, scanning, uploading, reviewing, and submitting Artwork Sheets according to the applicable Program instructions.
Before official submission, the School Coordinator is responsible for reviewing the online overview or preview of uploaded Artwork and confirming that, to the best of their knowledge:
By officially submitting Artwork or Program materials, the School Coordinator confirms that the submitted materials have been reviewed and approved for processing.
Art2fund is not responsible for issues caused by school-side scanning, uploading, cropping, orientation, file quality, wrong class assignment, wrong flyer distribution, wrong QR-code distribution, or other school-side submission or distribution errors unless Art2fund expressly caused the issue.
After Artwork processing, Art2fund may generate downloadable flyers or other Program materials personalized per Artwork and linked to a personal QR code or Access Code.
The Participating Organization and School Coordinator are responsible for downloading, printing, distributing, and communicating those flyers or materials correctly unless Art2fund has expressly agreed to perform those steps.
The Participating Organization and School Coordinator are responsible for ensuring that each flyer, QR code, or Access Code is distributed to the correct Student Artist or Parent.
If a Student Artist or Parent receives or activates the wrong flyer, QR code, Access Code, or Artwork association because of school-side distribution or handling, that is the responsibility of the Participating Organization or School Coordinator unless Art2fund expressly caused the issue. Parents and Buyers remain responsible for reviewing that the correct Artwork and Student Artist information are shown before activation, sharing, or ordering.
Teachers may access Class Websites and Class Galleries using the username and password provided for the applicable Program.
Teachers are responsible for keeping their login credentials confidential, using the Class Website and Class Gallery only for authorized Program purposes, and promptly notifying the School Coordinator or Art2fund if they believe their credentials have been lost, misused, or accessed by an unauthorized person.
Unless a Teacher is also acting as the School Coordinator or has been granted additional access, Teachers generally view Class Websites and Class Galleries and do not edit Artwork, Student Information, Program settings, or school administration data.
The School Coordinator is responsible for managing Teacher access, including resending Teacher login details, requesting changes to Teacher access, and informing Art2fund if a Teacher or other user should no longer have access. In some cases, Art2fund customer support may assist with Teacher access after taking reasonable steps to verify that the requesting person is authorized.
The Participating Organization and School Coordinator are responsible for deciding whether and how to share the School Gallery link.
They may choose to share the School Gallery link only with parents, with the school community, on a school website, with local media, through social media, or not at all, subject to school policy, applicable law, these Terms, and any separate written agreement with Art2fund.
Art2fund is not responsible for how a Participating Organization, School Coordinator, Teacher, Parent, Student Artist, Buyer, or invited viewer shares a School Gallery, Museum, Museum Shop, Personal Page, QR code, Access Code, or direct link after receiving access.
Art2fund may provide standard project communications, templates, flyers, emails, instructions, dashboards, coordinator tools, support materials, and other Program resources.
The Participating Organization and School Coordinator remain responsible for local project management, including communicating with families and teachers, distributing materials, meeting deadlines, following school policies, answering local questions, and ensuring that local instructions do not conflict with the official Program information provided by Art2fund.
Participating Organizations, School Coordinators, Teachers, and other school representatives may not make misleading, inaccurate, or unauthorized claims about prices, Products, sales tax, shipping, delivery timing, Program Proceeds, fundraising amounts, tax deductibility, donations, discounts, deadlines, product availability, privacy, gallery visibility, or Art2fund's responsibilities.
The Participating Organization and School Coordinator must promptly notify Art2fund if they become aware of:
The Participating Organization is responsible for complying with its own school, district, student-data, online-gallery, fundraising, vendor approval, and privacy policies.
If a Program includes Program Proceeds, Art2fund will calculate those Program Proceeds based on Art2fund's records, order data, payment data, refunds, cancellations, chargebacks, applicable Program terms, and any separate written agreement with the Participating Organization.
Program Proceeds are not calculated based on a Participating Organization's independent estimates, screenshots, informal counts, or local records unless Art2fund agrees otherwise in writing.
Program Proceeds are payable after the end of the applicable Program, subject to the applicable Program terms, refund and chargeback adjustments, payment processing, and any separate written agreement with the Participating Organization.
Art2fund may pause, restrict, close, delay, or end a Program if the Participating Organization or School Coordinator misses deadlines, submits incomplete or unusable materials, distributes incorrect materials, fails to provide required information, does not respond to reasonable requests, violates these Terms, creates a legal or operational risk, or otherwise prevents the Program from being operated properly.
Art2fund's collection, use, disclosure, retention, and protection of personal information, Student Information, and children's information is described in Art2fund's applicable privacy and data notices, which may include:
If there is a conflict between these Terms and an applicable Art2fund privacy policy or student data policy regarding privacy, data protection, student information, or children's information, the applicable privacy policy or student data policy will control for that subject matter.
During Personal Page activation, Art2fund may collect or confirm information needed to operate the Program and connect the Artwork to the correct Student Artist and class. This may include:
Activating a Personal Page does not create a general buyer account or parent account. Access to the Personal Page remains tied to the QR code, Access Code, or direct link associated with the flyer and Artwork.
Art2fund may use the email address linked to a Personal Page or Artwork to send project-specific communications, including project updates, deadlines, activation messages, page-related messages, Museum Shop activity, and information about orders placed through the Museum Shop.
Buyers who place guest checkout orders may receive order confirmations, shipping updates, customer-service messages, refund or replacement messages, and other order-related communications.
Art2fund will not send general marketing emails or newsletters to Parents, Buyers, family members, friends, or supporters based solely on Personal Page activation or guest checkout unless the recipient has separately opted in or Art2fund is otherwise permitted to do so by applicable law.
Art2fund may share information with service providers and partners where needed to operate the Services, run Programs, process orders, produce Products, deliver Products, provide support, secure the Services, and comply with legal and business requirements.
For example, Art2fund may share print-ready Artwork designs or production files with production partners. Art2fund may also share Buyer order details, such as name, shipping address, Product selections, and order information, with production partners, fulfillment partners, shipping carriers, and related service providers as needed to produce and deliver Products.
Payment information entered by a Buyer may be submitted directly to Art2fund's third-party payment processor. Art2fund may provide basic order and transaction information to the payment processor, but Art2fund does not intend to receive or store full payment card details entered directly with the payment processor.
Art2fund may also use hosting providers, email providers, analytics providers, security providers, customer support tools, payment processors, production partners, shipping carriers, and other service providers in connection with the Services.
Art2fund does not sell Student Information or children's personal information.
Art2fund does not use Student Information for targeted advertising or profiling.
Art2fund does not use Student Information or Student Artist Artwork to train artificial intelligence models.
Art2fund may process Student Information and Artwork for Program operation, Personal Page activation, gallery and Museum presentation, Museum Shop operation, Product production, order fulfillment, customer support, security, fraud prevention, quality control, legal compliance, accounting, and other purposes described in the applicable privacy and student data policies.
School, district, data processing, or student data agreements may include additional or different requirements. If Art2fund signs a separate written agreement with a Participating Organization, district, or other authorized party, that agreement may supplement these Terms for the subject matter it covers.
Retention, deletion, access, correction, and privacy request rights are described in the applicable Art2fund privacy and student data policies.
A Parent may request removal or deactivation of a Personal Page, Museum, Museum Shop, or related Digital Project Pages as described in these Terms and the applicable privacy notices. Removal or deactivation does not undo orders already placed and does not require Art2fund to delete records that Art2fund needs to retain for order fulfillment, customer support, accounting, legal compliance, security, fraud prevention, dispute handling, or other legitimate business purposes described in the applicable privacy notice.
The Services may include or rely on third-party services, such as payment processing, production, fulfillment, shipping, tracking, hosting, email delivery, analytics, security, support tools, school websites, carrier websites, or other external services.
Third-party services may be subject to their own terms, policies, privacy notices, availability, security practices, and processing rules. Art2fund is not responsible for third-party websites, services, policies, delays, outages, errors, or acts except to the extent required by applicable law or expressly agreed in writing.
Users should not republish, repost, scrape, copy, distribute, or share a Student Artist's Artwork, Personal Page, Museum, Museum Shop, Class Gallery, School Gallery, QR code, Access Code, or direct link outside the intended Program context without appropriate permission.
Family members, friends, supporters, Buyers, and other invited viewers receive access only for personal, Program-related viewing and ordering purposes. Receiving a link does not give an invited viewer ownership of the Artwork or permission to use it for unrelated commercial, public, advertising, social media, or promotional purposes.
Personal Pages, Museums, Museum Shops, Class Galleries, and School Galleries are intended to be accessed through QR codes, Access Codes, login credentials, or direct links, depending on the page type.
Art2fund does not intend Personal Pages, Museums, or Museum Shops for real Student Artists in active Programs to be searchable public profile pages. However, direct-link pages may be accessed by anyone who receives the relevant link, QR code, or Access Code, and Art2fund cannot guarantee that links remain private after they are shared by a Parent, Student Artist, Buyer, School Coordinator, Participating Organization, Teacher, invited viewer, or another recipient.

Parents, Participating Organizations, School Coordinators, Teachers, or other affected persons may contact Art2fund if they believe that Student Information, Artwork, a Personal Page, Museum, Museum Shop, Class Gallery, School Gallery, QR code, Access Code, direct link, or related content has been shared, activated, displayed, or associated incorrectly.
Art2fund may remove, disable, restrict, or suspend content, pages, galleries, Museums, Museum Shops, links, orders, or access while it reviews a privacy, student-data, security, copyright, or content complaint. Art2fund is not required to keep disputed content available while a complaint is being reviewed.
Art2fund may take action before completing an investigation if Art2fund reasonably believes that immediate action is appropriate to protect a Student Artist, Parent, Buyer, Participating Organization, Art2fund, or another person.
The Services, websites, software, platform, portals, tools, workflows, page layouts, templates, product previews, product mockups, designs, text, graphics, logos, icons, images, videos, instructions, educational materials, project materials, flyers, emails, dashboards, reports, trademarks, service marks, trade names, branding, Program names, and other Art2fund materials are owned by Art2fund or its licensors and are protected by intellectual property and other laws.
Except as expressly allowed by Art2fund in writing, Users may not:
Participating Organizations, School Coordinators, Teachers, Parents, and other Users may use Art2fund-provided Program materials only for the purpose of participating in, administering, communicating about, or supporting the applicable Art2fund Program.
These Terms do not transfer any Art2fund intellectual property rights to any User. All rights not expressly granted are reserved by Art2fund.
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
Art2fund does not warrant that the Services will be uninterrupted, secure, error-free, available at all times, compatible with every device or browser, free from viruses or harmful code, or that all defects will be corrected.
Art2fund does not warrant that:
Products are subject to the cancellation, return, refund, replacement, defect, damage, and production-error provisions in these Terms and any applicable support policy. Nothing in this disclaimer limits rights that cannot be waived under applicable law.
To the maximum extent permitted by applicable law, Art2fund and its officers, directors, employees, contractors, affiliates, service providers, production partners, licensors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, enhanced, or similar damages, including lost profits, lost revenue, lost fundraising proceeds, lost opportunity, loss of goodwill, reputational harm, loss of data, business interruption, replacement costs, or emotional distress, even if Art2fund has been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, Art2fund's total liability for any claim arising out of or relating to a Product order will not exceed the amount paid to Art2fund for the specific Product or order giving rise to the claim.
For claims that do not arise from a specific Product order, Art2fund's total liability will not exceed the greater of:
For Participating Organizations, any separate written agreement signed by Art2fund may contain different or additional liability limitations. If a separate written agreement applies, that agreement will control for the subject matter it covers.
The limitations in this section apply to all legal theories, including contract, tort, negligence, strict liability, warranty, statute, and any other theory, to the maximum extent permitted by law. Some jurisdictions do not allow certain exclusions or limitations of liability, so some limitations may not apply to certain Users.
To the maximum extent permitted by applicable law, each User agrees to defend, indemnify, and hold harmless Art2fund and its officers, directors, employees, contractors, affiliates, service providers, production partners, licensors, and agents from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
Participating Organizations and School Coordinators also agree to defend, indemnify, and hold harmless Art2fund from claims arising out of their internal approvals, school policies, district policies, fundraising approvals, vendor registration requirements, student-data policies, local communications, flyer distribution, QR-code distribution, upload decisions, gallery sharing decisions, and other school-side responsibilities, except to the extent the claim is caused by Art2fund's own breach of a separate written agreement or violation of applicable law.
Art2fund reserves the right to control the defense and settlement of any claim subject to indemnification, and Users agree to cooperate with Art2fund's defense.
Art2fund may suspend, restrict, disable, remove, or terminate access to the Services, a Program, account, Access Code, QR code, link, Personal Page, Museum, Museum Shop, Class Website, Class Gallery, School Gallery, administration tool, order, Product, discount, promotion, or User Content at any time if Art2fund reasonably believes that:
Art2fund may take action with or without prior notice where Art2fund determines that immediate action is appropriate. Termination or suspension does not limit Art2fund's right to retain records where required or permitted for order fulfillment, customer support, accounting, legal compliance, security, fraud prevention, dispute handling, or other legitimate business purposes described in the applicable privacy policy.
Art2fund may modify these Terms from time to time. Updated Terms may be posted on the Art2fund website, presented during activation or checkout, emailed to relevant Users, or otherwise made available through the Services.
The updated Terms will be effective as of the date stated in the updated Terms or as otherwise permitted by applicable law. Continued access to or use of the Services after updated Terms become effective means that the User accepts the updated Terms.
Art2fund may also change, suspend, remove, discontinue, or limit any part of the Services, Programs, Products, prices, sales tax calculations, shipping options, discounts, promotions, Digital Project Pages, galleries, Museums, Museum Shops, product previews, school tools, teacher tools, support tools, or other features at any time, subject to applicable law and any separate written agreement signed by Art2fund.
If Art2fund makes a change that affects an order already placed, Art2fund may cancel, refund, replace, modify, or otherwise resolve the affected order as described in these Terms or as required by applicable law.
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Services, a Program, a Product, an order, Artwork, User Content, or any relationship with Art2fund will be governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where applicable law requires otherwise.
Before filing a claim, each party agrees to try to resolve the dispute informally. A User must first contact Art2fund at legal@art2fund.com with a description of the dispute, the requested resolution, and enough information for Art2fund to identify the relevant account, order, page, Program, or issue.
Art2fund and the User will attempt in good faith to resolve the dispute for at least 30 days after Art2fund receives the notice, unless immediate legal action is required to prevent harm, protect intellectual property, protect privacy or student data, address unauthorized access, or comply with law.
Except for claims that may be brought in small claims court, claims seeking injunctive or equitable relief for unauthorized use, intellectual property misuse, privacy or student-data misuse, security incidents, or claims that cannot be arbitrated under applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, a Program, a Product, an order, Artwork, User Content, or any relationship with Art2fund will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable.
The arbitration will take place in New Castle County, Delaware, remotely, or by written submissions, as determined under the applicable arbitration rules and law. Judgment on the arbitration award may be entered in any court with jurisdiction.
Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court.
To the maximum extent permitted by applicable law, Art2fund and each User agree that disputes will be resolved only on an individual basis and not as a class, collective, consolidated, private attorney general, or representative action.
To the maximum extent permitted by applicable law, Art2fund and each User waive the right to a jury trial.
If the class action waiver is found unenforceable for a particular claim, the arbitration agreement may not apply to that claim, and the claim may proceed only in a court of competent jurisdiction.
For any claim that is not subject to arbitration or small claims court, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware, except where applicable law requires otherwise.
Nothing in this section prevents Art2fund from seeking injunctive, equitable, or other emergency relief in court to protect its intellectual property, confidential information, student data, privacy, security, Services, users, Programs, or business operations.
Art2fund will not be liable for delay, failure, interruption, non-performance, or reduced performance caused by events beyond Art2fund's reasonable control, including supplier issues, production partner issues, carrier delays, shipping disruptions, weather, natural disasters, fire, flood, epidemic, pandemic, labor disputes, strikes, war, terrorism, civil unrest, government action, legal restrictions, internet outages, hosting failures, payment processor issues, utility failures, equipment failures, cyber incidents, or other events beyond Art2fund's reasonable control.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified to achieve the closest lawful effect, and the remaining provisions will remain in full force and effect.
Art2fund's failure to enforce any provision of these Terms does not waive Art2fund's right to enforce that provision or any other provision later.
Users may not assign or transfer their rights or obligations under these Terms without Art2fund's prior written consent. Art2fund may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, reorganization, change of control, financing, corporate restructuring, or transfer of the Services or business.
These Terms do not create a partnership, joint venture, employment, franchise, fiduciary, agency, or similar relationship between Art2fund and any User, Participating Organization, School Coordinator, Teacher, Parent, Buyer, or Student Artist.
Users agree that Art2fund may provide notices, disclosures, updates, and communications electronically, including through the website, checkout flow, activation flow, project portal, school administration tools, email, support communications, or other Services.
Users are responsible for keeping contact information accurate and for reviewing communications made available through the Services.
These Terms, together with any applicable Program terms, checkout terms, privacy notices, student data policies, Parent Consent or Activation Terms, Artwork and Gallery Visibility Notice, and other terms presented through the Services, form the agreement between Art2fund and the User for the subject matter covered by those terms.
If Art2fund signs a separate written agreement with a Participating Organization, district, production partner, service provider, or other party, that separate written agreement may supplement or control over these Terms for the subject matter it covers.
Headings are included for convenience only and do not affect the interpretation of these Terms.
Words such as "including" mean "including without limitation." References to "or" are intended to be inclusive unless the context clearly requires otherwise.
